“We’re sending a message to the president today asking him to do two things. One, return bankruptcy rights to all federal student loans, which he can do by executive order, and use the Higher Education Act to cancel loans,” Collinge said. Please do your part, and send a message like this to the President: ------------------------- Mr. President, In light of the election, I strongly urge you and Department of Education/Justice staff to: 1. Scrap the new bankruptcy process for student loans. It does nothing but give the power of undue hardship determination to conflicted bureaucrats at ED and Justice. It is also a clear violation of the spirit, if not the letter of the Chevron Deference judgment. 2. Simply stop opposing- and order ED contractors like ECMC to stop opposing- bankrupted student loan borrowers. Undue hardship is vaguely defined, and it is easily found that filing for bankruptcy, in itself, is proof enough of undue hardship. This was the original idea, as you know. . 3 Use 1082 a (6) to cancel loans in a bold way that precludes lawsuits and injunctions. Just do it. I know you know how. The stakes are high, Mr. President, both for the country and for your legacy. We are already seeing an uptick in horrifying tragedies related to this predatory lending system, and this will get far worse quickly in the coming months and years unless you act. God did not put you on this earth to cause the mass suffering and perpetuate/create tyranny like what is now imminent, Mr. President. I should think the opposite is true.
