Dr. Wayne Johnson, the former Chief Operating Officer of the federal student loan program, has launched a class action lawsuit against the Department of Education and the Credit Reporting Agencies. http://www.studentloanlegalaction.org/ This case will represent student loan borrowers who saw their credit scores drop because of their student loans over this year. The Supreme Court ruled last year that federal agencies who run lending programs- and their contractors- can no longer claim sovereign immunity for violations of the Fair Credit Reporting Act (FCRA). In other words, they can be sued in court. If your credit score dropped this year because of your student loans (particularly if you experienced difficulties in contacting them due to long hold times, dropped calls, etc), then you should contact them now: http://studentloanlegalaction.org This suit seeks damages of $100k/borrower, and also seeks the return of bankruptcy rights as a remedy. I estimate that 5-10 million people will have good cause to join this lawsuit. Perhaps more. This case opens a new door of redress for student loan borrowers.
