4/27/2023 Don't be fooled by this...Hey Everyone:
Today's action is very quick: Important: Don't be fooled by the stories being seeded in the media about people getting their loans discharged through the "new" bankruptcy process, folks. You'll be able to spot them, by how they fail to present the opinions of those who are critical of the process...something reporters used to do. The "new" bankruptcy process is essentially the same as it has ever been. Undue hardship remains in place. Borrowers STILL have to pay thousands upon thousands of dollars over and above their bankruptcy filing fees to initiate an adversarial proceeding, and the huge likelihood of being denied is still there. The only difference with this new process is that instead of undue hardship being determined by a judge, it is now essentially decided by bureaucrats/contractors at the Department of Education (these are the same people who have opposed borrowers for going to MacDonalds on Sundays, or having 15-year old children who could work to help pay off their parent's loans). The Swamp has been doing this for years. They trot out rare cases of discharge and point to it as proof that bankruptcy is possible for student loans. Please do not be fooled. This is a trick that the student loan swamp people have been playing for years, and I suspect we'll be seeing a lot of more going forward. See this article to understand this more fully.
